CDHS ACWDL 96-27 -- May 24, 1996 (Synopsis): California Medical Assistance (Medi-Cal) -- California Residency

This ACWDL clarifies three significant issues impacting determinations of California residency for Medi-Cal eligibility, as follows:

EVIDENCE CONTRARY TO AN APPLICANT OR RECIPIENT'S CLAIM OF CALIFORNIA RESIDENCY

Several examples of "evidence to the contrary" are provided. There is a brief discussion about weighing all evidence and basing a finding of California residency on a "preponderance of the credible evidence."

BORDER CROSSING CARDS

Possession of a Border Crossing Card is strong but not conclusive evidence there is no California residency.

B1/B2 VISAS

Individuals possessing B1/B2 visas are temporarily visiting in the United States. Except in exceptional cases, such individuals are not California residents and thus not eligible for Medi-Cal. Two examples are given about individuals in California on a B1/B2 visa; one example establishes California residency and the other example establishes nonresidency in California.
